A virus that has plagued small business websites for years has become alarmingly widespread in recent times. We are not referring to an outbreak of the flu or a computer virus, but rather the frequent occurrences of photographic image and text theft throughout the Internet. The increased popularity of having a web presence has resulted in more new businesses publishing websites every day. Unfortunately, whether it is blatant unethical business practice or a lack of knowledge of the copyright laws, many new businesses are using photos and or text taken from established websites, thus violating Federal copyright laws. Certainly, this is an unacceptable business practice and must be stopped. However, can we really stop it and find a cure?
Is there a perfect solution to stop image and text theft? We might suggest applying the “disable right click” code onto sites. Another deterrent may be applying a watermark or copyright symbol to the image.  Both of these are good ideas, but a well-informed web person or a good photo program can “undo” these techniques.
So what are we left to do? We must educate ourselves and others about copyright laws, keep a vigilant watch on the Internet for violators, and report them immediately.
To begin educating new business owners, we must first understand the copyright laws. The following information was obtained from the U.S. Copyright Office and gives a brief overview of the copyright laws. Please visit them for more information.
What is Copyright? – Copyright is a form of protection provided by the laws of the United States (title 17, U.S. Code) to the authors of “original works of authorship,” including literary, dramatic, musical, artistic, and certain other intellectual works. This protection is available to both published and unpublished works.
Who can claim Copyright? – Copyright protection subsists from the time the work is created in fixed form. The copyright in the work of authorship immediately becomes the property of the author who created the work. Only the author or those deriving their rights through the author can rightfully claim copyright.
What works are protected? – Copyright protects “original works of authorship” that are fixed in a tangible form of expression. The fixation need not be directly perceptible so long as it may be communicated with the aid of a machine or device. Copyrightable works include the following categories:
1.     literary works;
2.     musical works, including any accompanying words
3.     dramatic works, including any accompanying music
4.     pantomimes and choreographic works
5.     pictorial, graphic, and sculptural works
6.     motion pictures and other audiovisual works
7.     sound recordings
8.     architectural works
How To Secure A Copyright? – The way in which copyright protection is secured is frequently misunderstood. No publication or registration or other action in the Copyright Office is required to secure copyright. There are, however, certain definite advantages to registration. See “Copyright Registration.”
Copyright is secured automatically when the work is created, and a work is “created” when it is fixed in a copy or phonorecord for the first time. “Copies” are material objects from which a work can be read or visually perceived either directly or with the aid of a machine or device, such as books, manuscripts, sheet music, film, videotape, or microfilm.
Notice of Copyright – The use of a copyright notice is no longer required under U. S. law, although it is often beneficial. Because prior law did contain such a requirement, however, the use of notice is still relevant to the copyright status of older works.
Notice was required under the 1976 Copyright Act. This requirement was eliminated when the United States adhered to the Berne Convention, effective March 1, 1989. Although works published without notice before that date could have entered the public domain in the United States, the Uruguay Round Agreements Act (URAA) restores copyright in certain foreign works originally published without notice. For further information about copyright amendments in the URAA, request Circular 38b.
The Copyright Office does not take a position on whether copies of works first published with notice before March 1, 1989, which are distributed on or after March 1, 1989, must bear the copyright notice.
Use of the notice may be important because it informs the public that the work is protected by copyright, identifies the copyright owner, and shows the year of first publication. Furthermore, in the event that a work is infringed, if a proper notice of copyright appears on the published copy or copies to which a defendant in a copyright infringement suit had access, then no weight shall be given to such a defendant’s interposition of a defense based on innocent infringement in mitigation of actual or statutory damages, except as provided in section 504(c)(2) of the copyright law. Innocent infringement occurs when the infringer did not realize that the work was protected.
The use of the copyright notice is the responsibility of the copyright owner and does not require advance permission from, or registration with, the Copyright Office
Form of Notice for Visually Perceptible Copies
The notice for visually perceptible copies should contain all the following three elements:
1. The symbol © (the letter C in a circle), or the word “Copyright,” or the abbreviation “Copr.”; and
2. The year of first publication of the work. In the case of compilations or derivative works incorporating previously published material, the year date of first publication of the compilation or derivative work is sufficient. The year date may be omitted where a pictorial, graphic, or sculptural work, with accompanying textual matter, if any, is reproduced in or on greeting cards, postcards, stationery, jewelry, dolls, toys, or any useful article; and
3. The name of the owner of copyright in the work, or an abbreviation by which the name can be recognized, or a generally known alternative designation of the owner.

The idea of placing a copyright notification like the above example on each of your photos is a good idea. While the removal of this ‘stamp’ is possible in a photo-editing program, the ‘stamp’ itself may prove to be a good deterrent. It also shows a possible thief that you are aware of the copyright laws. Having a statement on your site saying something to the affect of “All images found on this site are © 2003 XYZ Baskets. All violators of the copyright laws will be prosecuted.” This statement may also work as a deterrent.
*Note:Â Placing a copyright notification on each of your photos and a copyright statement on your website may be an effective deterrent.*
How long Copyright Protection Endures – Works Originally Created on or after January 1, 1978
A work that is created (fixed in tangible form for the first time) on or after January 1, 1978, is automatically protected from the moment of its creation and is ordinarily given a term enduring for the author’s life plus an additional 70 years after the author’s death.
What do you do if you find that someone has stolen your pictures or text?
Copy the site to disk so you have proof of the theft.
You (or your attorney) need to contact the offending website with a cease and desist order insisting that they remove your image.
Send the same information to the websites hosting company. Per the Digital Millennium Copyright Act of 1998, a service provider must adopt and reasonably implement a policy of terminating in appropriate circumstances the accounts of subscribers who are repeat offenders. For a full copy, visit Digital Millennium Copyright Act of 1998.
The copyright laws are clear and concise. The photographic and text theft that is occurring on the internet is a Federal offense and prosecutable. If you are new to business and the internet, keep this information in mind when creating your website and utilize your own work. We all need to be familiar with the copyright laws, and become proactive. We can accomplish this by:
·       Educating new business owners
·       Being vigilant in reporting violators
·       Informing the violators that this is an illegal practice and prosecutable
Small businesses need to band together to prevent this unethical and illegal business practice. We must treat the symptoms of this widespread virus in order to find a cure.

One time, when I was a young man of about 23 years old, I bought a small, starter home in Marietta, Florida. It was about 25-30 minutes away from the Navy Base where I was assigned. The house was tiny and old. It was warmed by heating oil from a fuel tank located behind the house.
Winters in this upper part (almost Georgia) of Florida were very cold.
- One Thing after Another -
I was a low ranked enlisted man and newly married. We constantly struggled to make ends meet. Then the wife got laid off from her job.
Unexpectedly, a cold front came in from nowhere – way too early than all forecasts. And, as you would expect, we were out of heating oil and money.
I had never felt so helpless in all my life. Negativity entered my mind and I just sat on my front porch, feeling almost paralyzed, bundled up in two pairs of pants and three coats.
My wife tried to console me, but all I could think about was how much of a failure I was. No matter how much I tried to plan out our budget, something always seemed to pop up.
Many times I would have to get advance loans on my paycheck. These advances were ridiculously expensive – sometimes 20-30% interest, not including the up-front processing fees!
Of course, that just left me starting the next month with a smaller paycheck.
- Distraction or Serendipity -
Yes, I was feeling sorry for myself. How did I get this way? I always worked very hard. I was never extravagant in any area of our financial matters. How? Why? It just didn’t make sense at the time.
Then, some activity in the house across the street distracted me; momentarily freeing me from the current “woe-is-me syndrome.â€Â
It looked like my neighbor was moving.
I had known the old man for about eight months (the total time I was at home from military operations in the last year and a half). Because he seemed so lonely, I always made it a point to say hello. I helped him with his yard when I could, and let him tell me about his life.
The man’s solitary situation reminded me how lucky I was to have my wife. I was instantly filled with a great sense of gratitude for the love and companionship of my wife. Although we were going through some rough times, we always seemed to remember what we really meant to each other.
Now it looked like this lonely, old man was moving?
I hoped everything was going to be okay for him. I didn’t see a “for Sale†sign in his yard, so I walked across the street and peered into his open front door. Yes, all his things were all boxed up. When he walked into his living room carrying another box, I took it from him and placed it next to the others.
After chatting for a bit, he told me that his daughter and husband extended an invitation to live with them up north; and that he was eager to be around his grandchildren. I sincerely wished him good luck and asked him if he needed help with anything else.
Then something miraculous happened.
The man told me that everything was done except for one thing. He had to stay for two more days because the people he was paying to drain his heating oil tank were too busy! Immediately I volunteered to do it for free!
He was overjoyed.
I was stunned.
He was totally unaware of my desperate need for heating oil and was simply happy to be leaving earlier.
Can you believe it?
One minute I’m feeling sorry for myself because I thought my wife and I would freeze; and now my neighbor was giving me a full tank of heating oil – enough to last for at least three payday periods!
- Universal Laws in Action -
The Law of Attraction: Like causes attract like effects. Being positive attracts more positive things into your life; while negativity attracts more negative things.
The Law of Cause and Effect: Sowing and reaping, karma, or “what goes around comes around,†etc. You literally get back what you dish out. It is true that no bad deed goes unpunished. If you live by the sword, you die by the sword.
The Law of Cause and Effect goes hand in hand with the Law of Attraction. These laws govern all our lives (and the rest of the Universe). They operate perfectly and without prejudice – all the time.
- Accumulated Returns -
Good deeds always result in some form of goodness coming back to you. In fact, whether negative or positive, the result that “rebounds†back from the universe will often be many times larger than what was initially “thrown†out there.
Here’s a simplified explanation for this “multiplied rebound†phenomena:
When you act or think, the effects of your actions and thoughts spread out through the universe like the ripples made when a pebble is thrown into calm water. As your effects travel outward into the universe, they touch everything in its path. In turn, those affected – from the furthest to the nearest – respond with their own “ripples†back towards you.
Each response is added to the group of “returning ripples;†eventually growing into a “returning wave.â€Â
Depending on how far in the universe and how many were affected by your thoughts or actions, the accumulated return from the universe could be the size of a small wave; or the size of a good surfing wave; or the size of an enormous tsunami!
- Heating Oil and Universal Laws -
Now, I understand why the above “heating oil†event unfolded the way it did.
In the beginning, the negativity and self-pity I kept focusing on actually attracted more of the same (Law of Attraction). When I replaced the negative thoughts with gratitude (the love of my wife), things immediately changed for the better.
When I stayed positive and offered to help the old man, the universe responded in kind; giving me a massively good thing in return (the heating oil)!
And I re-examine my other “guardian angel,†miracle experiences, it all really makes sense now. Whenever I obeyed the Universal Laws setup by the Original Substance (God), something or someone always appeared out of nowhere to help me in my hour of need.

How to Conduct a Patent Search

Alright, so you have determined you need to conduct a patent search but you’re not sure where to start? Well the folks here at Noro IP have put together some tips and tricks to help get you started.
Home Grown Detective Patent Search
First off in the simplest sense if someone has patented your idea already you will not be eligible for a patent. So the easiest way to figure out if you can get a patent is to look at items in stores and already in the marketplace. If you see your idea already implemented then it is unlikely you will be granted a patent (*unless it is an unobvious improvement).
Search Engine Patent Searching
1. Perform a Google search for your invention and see if it is in the market already. This is another really easy and free way to determine your likelihood of success. (Google also has recently launched a free patent search feature www.google.com/patents that makes for a great place to search for patents)
2. You can search the U.S Patent and Trademark Office online yourself (http://patft.uspto.gov/). The USPTO has a free search engine where you can perform a basic patent search yourself. Any patent that has ever been issued is contained in the USPTO’s database so this is an ideal place to look for other inventions similar to your own.
3. You can also do a patent search by using third party search engines. Most of these won’t be free but there are several out there and some of them have special rates for individuals looking for only a 3 day or less search pass.

While it’s completely possible to conduct a patent search on your own there patent agents, attorneys and companies out there that specialize in conducting patent searches. They have access to patent information areas that aren’t publicly accessible and they also will have a great idea where exactly to search for inventions similar to your patent. Is a Website’s Look and Feel Protected?
The advent of the Internet has totally revolutionized the business world by opening up new avenues for companies and organizations to promote their products and services more effectively. The greatest advantage is increased visibility. With people becoming dependent on the Internet for everything from shopping, booking tickets and gathering information, companies have realized the significance of creating a strong web presence for brand awareness. Hence, companies and organizations now devote a great deal of attention to designing for the web.The ultimate goal of creating a website is to generate high quality traffic and translate it into sales and profits. Therefore, it is necessary to make the website as attractive, unique, user friendly and informative as possible. Much effort and creative thinking goes into the process of giving a website a distinctive identity of its own that complements a company’s image.
Website design and copyright lawsAs stated above, much effort goes into the process of designing websites, but a lack of adequate copyright protection has made it easy for others to imitate certain design aspects with no fear of copyright infringement. Copyright laws protect certain aspects of the overall look and feel of a website, including content, images, software code, graphic elements, and others. However, functional elements such as font, style, layouts, color schemes, use of tabs, boxes, hyperlinks and others have little protection under copyright laws. If the design and style is outstanding, then the customers’ minds spontaneously correlate the website design with the company’s products and services. Through the website, the company or organization has succeeded in developing a distinctive identity of its own. Hence, imitating website design is nothing short of identity theft.
Website ‘look and feel’ and legal protectionThere has been an increase in the number of lawsuits regarding  the imitation of original website design pending in courts. Understanding the limitations of copyright laws and the implications of not providing adequate legal protection to well-designed websites, courts have decided to enforce protect able trade dress under the Lanham Act, also known as the Trademark Act, on the look and feel of a website. Though trademarks apply to a name, word, phrase, symbol, or image that helps customers to identify it from its competitors, trade dress refers to the image and impression that the product creates to distinguish it from its competitors. This theory is therefore applicable to the case of website look and feel since competitors are essentially trying to create confusion in customers’ minds by imitating a web design.
This is a landmark judgment as it would not only reduce the number of ediscovery requests, but would also be a welcome relief for hundreds of companies whose website designs have been imitated. Moreover, if companies want to prevent lawsuits pertaining to web design imitation and subsequent e discovery requests, they should make sure that both website content and design is entirely original.

Music Matters Scoop: China’s Plan To Fight Piracy

I don’t usually go to conferences expecting to get scoops. Oh sure, you have lots of announcements – so and so have partnered, such and such launches new service, blah, blah, blah… Didn’t he announce that at another conference last month? Even during last year’s Music Matters, the launch of Google Music China had been covered well beforehand, though it was neat to actually get a demo. So I had to literally stop and rub my ears when I could have sworn that I’d caught a scoop at this year’s Music Matters.
The setting was a presentation by 88tc88, which had introduced at SXSW its Web-based translation service for Western bands wanting to enter the Chinese market – more about that here. Joining Chairman Thomas Reemer, CEO Christopher Martius and Partner Yushu Le Guyader (who provided translation) on the stage was Bill Zang, Vice President at Shanghai Synergy Culture & Entertainment Group. Owned by one of the largest media conglomerates in China, SSCEG is at the core of the Chinese government’s efforts to develop comprehensive multimedia entertainment services for its domestic market while fighting piracy and addressing royalty collection.
Let me stop here to remind readers of a little fact. Until relatively recently, copyright in China was illegal. All intellectual property belonged to the people, ie. government. If you wrote a book for example, the government would ‘own’ it and reap any ‘profits,’ while providing the author with a salary, housing, medical and education. So when some rant on about piracy or the lack of enforcement, this should be put in context. The Copyright Law of the People’s Republic of China was adopted in 1990 – we in the US on the other hand have had a Copyright Act on the books since 1790 and we still can’t seem to get it right!
On the other hand, the government does often seem capricious in its enforcement of copyright. They like to point to last year’s shutdown of 200 pirate movie sites, including the largest video BitTorrent site. It just so happens though that the crackdown coincided oh so nicely with the launch of CCTV’s major online video initiative. Nor is it clears whether the shutdown didn’t have more to do with fighting pornography – a much bigger taboo for the government – rather than piracy. Having said that though, the fact is that for both economic and diplomatic/political reasons, the Chinese government will increasingly get serious, get tough and tackle the IP issue in the broad sense, not just piracy.
For one thing, China is no longer the low-quality, copycat manufacturer people still seem to imagine. As its economic power has grown, so has domestic innovation. It is following the path of Japan and South Korea, except at warp speed. You’ve certainly heard that they now have the fastest train, 2nd most powerful computer,… you get the picture. Nor is all this growth in IP restricted to patents & gadgets. Anyone who has hung out at Beijing’s indie clubs like D-22 and Yugong Yishan, or strolled through its 798 Art District quickly realizes that China has a big cultural muscle it is anxious to flex. So it will become an economic imperative to protect its intellectual property which the government will increasingly view as a strategic asset.
Secondly, the Chinese government wants to attract more Western culture and the know-how that comes with it. To do this, they are building three national music industry parks, located in Shanghai, Beijing, and Guangdong that are slated to be operational in 2011. These high-tech parks will serve as performance stages as well as provide facilities for Western and Chinese musicians and professionals to collaborate. But of course, in order to attract Western musicians and firms, they need to tackle piracy.
This is all good, but it is at this point where I start get sceptical. It’s fine to talk about tackling piracy and shutting down sites, but without a strategic plan to develop a legal market for IP content, it’s pretty much talk. So it was with a little surprise (shared by my friends at 88tc88 who assured me it wasn’t in the script) that I heard Mr. Zang get very specific and present the outlines of a plan: The Chinese government will use watermarking technology to embed a unique code into every creative works released – music, film, graphic,… – allowing the government to easily identify, fine and shut down websites peddling pirated material as well as track all plays for royalty collection and disbursement.
“That’s it?! Aren’t we doing that already?” you say. Sure, watermarking technology has been around for well over a decade and while not a panacea, has become an important tool in IP management and protection. But it is the fact that the government is publicly outlining a strategy and process to tackling the problem which is a watershed… and the scoop. Even more encouraging was the emphasis on using the technology not just to fight piracy, but also properly compensate rightsholders for the use of their music. Just consider that China has the potential to be the largest music market in the world, easily surpassing the US and Japan.
And unlike in the West, when the Chinese government sets its mind to something, it usually gets done.
